Returns and Refunds
- Information on the general right of withdrawal and returns of damaged or defective products
1.1 Pursuant to Article 52 of the Consumer Code, the Customer has the right to withdraw from the contract concluded with the Seller, without penalty and without specifying the reason, within 14 (fourteen) days from receipt of the "Order Summary" email referred to in Article 3.8 of the Terms and Conditions of Service section above. Only in the event that the product received by the customer presents damage or defects attributable to the supplier or the carrier and recognizable by the latter upon delivery, the 14 (fourteen) day period will run from the date of delivery of the goods certified by the carrier. This is provided that the damage or defects are promptly reported by the Customer to the supplier with photographic attachments. The deadline is timely if and when the report is made in writing within 48 hours of receipt of the damaged goods.
1.2 To exercise the right of withdrawal, the Customer must contact us at the following addresses: Archimede R&D Srl headquarters, Via della Meccanica, 1, 41018 San Cesario Sul Panaro (MO), email info@doctorneu.com, telephone: +39 059 9775460, informing us of the decision to withdraw from this contract by means of an explicit declaration (e.g., a letter sent by post or email). To this end, you may use the attached standard withdrawal form, but it is not mandatory. (link to withdrawal form).
1.3 To comply with the withdrawal deadline, it is sufficient for the Customer to send the communication relating to the exercise of the right of withdrawal before the withdrawal period expires.
- Effects of withdrawal
2.1 If the Customer withdraws from the contract, we will reimburse all payments received from you, including delivery costs (with the exception of any additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery type offered by us), without undue delay and in any case no later than 14 days from the day on which we are informed of your decision to withdraw from this contract. Such refunds will be made using the same means of payment used by the Customer for the initial transaction, unless the Customer has expressly agreed otherwise; in any case, you will not incur any fees as a result of such refund.
2.2 The refund may be suspended until the seller/supplier receives the returned goods or until the consumer has demonstrated that he/she has sent the goods back, whichever is earlier.
2.3 The Customer is requested to return the goods or deliver them to Archimede R&D Srl, Via della Meccanica, 1, 41018 San Cesario Sul Panaro (MO), without undue delay and in any case within 14 days from the day on which they communicate their withdrawal from this contract. The deadline is met if the Customer sends the goods back before the 14-day period expires.
2.4 Returned Products must be intact (unless the withdrawal and return are motivated by receipt of damaged or defective goods – see art. 1.1 above), placed in their original packaging and wrapping, complete with any accessories and everything received in conjunction with the Products, including discount vouchers or free gifts, and without any missing items.
2.5 The direct cost of returning the goods will be borne by the Customer. The Customer is only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
2.6 In the event of the return of goods received damaged or defective pursuant to the previous art. 1.1 and the damage or defect of which was promptly reported pursuant to art. 1.1 above, the return costs will be borne by the supplier, who, if explicitly requested by the Customer, will proceed with the replacement of the products through a new shipment.
- Return of products not compliant with the order
3.1 Contrary to what is specified in art. 1.1 above, the product is considered non-compliant with the order when, despite having been delivered intact, undamaged and not defective in any way, its nature, composition and characteristics are different from those indicated in the "Order Confirmation" and "Order Summary" emails.
3.2 If the delivered Product does not conform to the order, upon verification by the Seller, the Customer, as also specified in the previous art. 2.6, has the right to request a replacement of the Product, or, where such remedies are not possible or excessively onerous, has the right to a reduction in the price paid or to terminate the sales contract, pursuant to art. 130 of the Consumer Code. (The seller is liable to the consumer for any lack of conformity existing at the time of delivery of the goods.)
3.3 If the Customer does not intend to keep the product determined to be non-compliant pursuant to the previous articles 3.1 and 3.2 and therefore opts to terminate the sales contract with a refund of the price, the parties may agree not to proceed with the return/return of the non-compliant goods, if this would be economically disadvantageous for the supplier.
3.4 In any case, the return will be at the Customer's expense, except in the cases referred to in the previous articles 1.1 and 2.6 (damaged or defective goods due to the supplier/seller or the carrier's responsibility, with damage or defects recognized by the carrier itself at the time of delivery).
3.5 The Seller reserves the right to request photographic evidence before authorizing the return of Products declared as non-compliant.
3.6 Upon receipt of the returned Product, the Seller will verify the actual existence of the defect complained of and that the damage is not attributable to the Customer or to normal and proper use of the Product. In fact, so-called supervening defects, i.e., defects due, for example, to use of the Product, are excluded from the legal guarantee.
